Pennsylvania Skill Games Ruling Ups Ante for New Rules

June 24, 2026

The Pennsylvania Supreme Court held on June 15 that skill games are subject to the same regulatory oversight as slot machines, and delayed implementation by 120 days to give the General Assembly time to respond. Practitioners told Law360 the decision ends the legal gray area that had removed any incentive for the industry to support legislation, and expect intense lobbying from game manufacturers, the taverns and convenience stores hosting roughly 70,000 terminals, and licensed casino operators. Pennsylvania’s Independent Fiscal Office has estimated that taxing the machines at 52 percent would generate approximately $487 million in the coming budget year. Because the court applied a broad statutory definition of “slot machine,” commentators noted the ruling could reach well beyond skill games to ordinary pay-to-play amusement devices at arcades, theme parks, and family entertainment venues.

Firm involvement: Alexander Denton, who represents clients in Georgia’s skill games industry, was quoted on the decision’s potential reach into arcade and family entertainment businesses.
