Firm Secures Denial of Certificate of Need by the Department of Community Health

Today, Robbins Firm attorneys Josh Belinfante and Dan Monahan secured a denial by the Georgia Department of Community Health of an application for a certificate of need to develop a Non-Special Megavoltage Radiation Therapy Service (“NSMRT”) in Augusta, Richmond County, Georgia.

The Robbins Firm opposed the application on behalf of Doctors Hospital of Augusta, a competing healthcare facility that provides comprehensive cancer treatment to patients in and around Augusta.  At an oral hearing on the application, Dan Monahan provided argument for why the applicant did not satisfy the relevant need criteria or any exceptions to need under applicable Department rules that would warrant the proposed project moving forward. 

The Department agreed with the Robbins Firm’s arguments, denying the application based on, among other things, the applicant’s failure to demonstrate an exception to need for a new NSMRT program, as well as on the availability of services from existing providers, including Doctors Hospital of Augusta, in the relevant service area.  A copy of the Department’s decision is available at https://weblink.dch.georgia.gov/WebLink/DocView.aspx?id=1003199&dbid=1&repo=HealthPlanning.
