Firm Secures Approval from Department of Community Health in Certificate of Need Case

Today, Robbins Firm attorneys Josh Belinfante and Dan Monahan secured a reversal of the initial denial of a contested Certificate of Need (“CON”) application.  The firm’s client, a national healthcare company, sought Commissioner review of the Georgia Department of Community Health’s decision to deny a CON to establish the first ever Level II Neonatal Intensive Care Unit (“NICU”) in Bartow County, Georgia. 

The application had been denied in two earlier stages of review.  However, the Robbins Firm presented strong legal authority on appeal, demonstrating why the project was warranted according to a line of agency precedent granting CONs to similar projects in other markets throughout the State.  The Commissioner agreed, overturning the denials and permitting the much-needed NICU project to move forward.
