Firm Obtains Order Dismissing Complaint for Non-Service

The firm represented a Maryland medical consulting company and a chiropractor who had been sued in Georgia for breach of contract and trade secrets violations.  The plaintiff in that lawsuit served the lawsuit on a separate entity which was only loosely affiliated with our client.  After we filed a motion to dismiss for improper service, the plaintiff made various other attempts to serve the Complaint, and accused our clients of evading service.  In fact, the various affidavits of service filed showed that our clients were never served, despite their service address being a matter of public record and known to the plaintiff.  The Court agreed with us, and dismissed the Complaint, without our client ever having to make a formal appearance in Georgia’s courts.
