Firm Lawyers’ Reversal of Zoning Board of Appeals Upheld by Georgia Court of Appeals

The Robbins Firm secured a unanimous decision in the Georgia Court of Appeals, affirming a favorable decision by the Superior Court of DeKalb County.  Our client sought to open a residential treatment center for adolescents with eating disorders in the City of Dunwoody.  The City of Dunwoody initially confirmed the proposed used complied with the existing zoning regulations, but four months later, in April 2014, a group of Dunwoody residents filed an untimely appeal of the classification with the Dunwoody Zoning Board of Appeals (“ZBA”) for administrative appeal of the zoning confirmation.  The ZBA heard the appeal and reversed the City’s decision.  Our client appealed to the superior court, and the court reversed the ZBA on three independent grounds.  The Court of Appeals upheld the decision.
