Firm Helps Client Overturn Denial of Certificate of Need by the Department of Community Health

Today, Robbins Firm attorneys Josh Belinfante and Dan Monahan secured the reversal of a Certificate of Need decision issued by the Department of Community Health.  Hearing Officer Mel Goldstein at the Department of Community Health reversed the Department’s initial decision denying a certificate of need to firm client American Health Imaging to add a CT scanner at its Marietta Imaging facility in Cobb County. 

Based on the evidence presented on appeal, Hearing Officer Goldstein determined that American Health Imaging demonstrated the existence of need, and lack of sufficiently available alternatives, for additional CT systems in the service area, leading him to reverse the Department’s denial of the application.
