Firm Defeats Motion for Summary Judgment in Commercial Lease Dispute

Robbins Firm attorney Dan Monahan recently argued and overcame a motion for summary judgment in a hearing before the Superior Court of DeKalb County.  The underlying dispute involves a commercial lease of highly valuable retail property in the Old Fourth Ward neighborhood of Atlanta.  The firm’s client, a regional petroleum industry entrepreneur, sued its tenants over breaches of the lease.  The tenants moved for summary judgment on all counts of the client’s complaint.  The Court ruled from the bench immediately following oral argument, denying the motion in its entirety and permitting all counts to proceed to trial.
