Firm Client Receives $850,000 And Ability To Operate Eating Disorder Clinic In Zoning Dispute

The Firm’s client sought to open a residential treatment center for children with eating disorders in Dunwoody, Georgia.  The City initially decided that the proposed use complied with existing zoning laws, but it referred an untimely appeal to the Zoning Board of Appeals, which reversed the City’s decision.  After the Superior Court of DeKalb County reversed the Zoning Board of Appeals’s decision, our client filed a federal lawsuit alleging violations of the Fair Housing Act and United States and State Constitutions.  After discovery, and after the Georgia Court of Appeals upheld the Superior Court’s decision, the City settled federal lawsuit for $850,000 and agreed to allow our client to open the eating disorder clinic as planned.
