Partner Josh Belinfante Speaks to Select Georgia Leaders on the Impact of Certificate of Need Laws

On January 29, Josh Belinfante, the lead regulatory and healthcare attorney at the Robbins Firm, spoke to the Conservative Policy Leadership Institute on the impact of Certificate of Need (“CON”) Laws here in Georgia.  Unlike most industries, the healthcare services industry is governed by strict statutory and regulatory criteria which determines if a healthcare provider can establish a facility.  Under these CON laws, certain healthcare facilities must demonstrate that the services are needed in the area the facility seeks to serve.  Given the current healthcare market, especially in metro Atlanta, this “need” is becoming increasingly difficult to demonstrate and many providers are now relying on various exceptions to need created by the Department of Community Health.
