Summary Judgment Motions Defeated In Multi-Family Property Case

We represent a California real estate investment and development company that attempted to purchase a multi-family housing property in Roswell, Georgia. Both the seller of the property and the property’s manager failed to disclose their knowledge of the City of Roswell’s plans to condemn a significant portion of the property. We asserted claims of negligent and intentional misrepresentation, breach of contract, and breach of fiduciary duty against the property manager, and breach of contract against the seller. Both Defendants filed motions for summary judgment, which were denied in their entirety.
