Firm Secures Summary Judgment against Defendant on Personal Guaranty

We represent an individual who provided substantial funds to a close family friend – a real estate developer.  The real estate developer often asked our client for loans for various real estate projects, and he previously signed a personal guaranty that made him personally liable for all current and future loans our client made to his company.  This week, Judge Brasher in Fulton County Superior Court agreed with our firm and granted summary judgment in our favor on our client’s claim against the developer on a $200,000 loan.   The Court noted that the personal guaranty language is clear and applied to the loan which had been made after the execution of the personal guaranty.  This judgment will allow our client to begin the collection process while pursuing her other claims against this developer.
