Firm Defeats Four Motions in Self-Dealing Case Involving Highly Valuable West Midtown Property

Robbins Firm attorneys Richard Robbins and Dan Monahan recently overcame four separate motions, including a motion to transfer, a motion for protective order, and two motions to dismiss, in a consolidated hearing before the Superior Court of Gwinnett County. The underlying dispute involves a self-dealing “flip” of real property in the booming West Midtown neighborhood of Atlanta.  The firm’s client, a regional real estate investment firm, was divested of over $1 million as a result of the deliberate structure and timing of the transactions orchestrated by the defendants.  Richard and Dan showed the Court why venue in Gwinnett County was proper, why discovery from third parties was critical, and further illustrated the legal merit of each of the client’s claims in the face of the transactions.  Following the hearing, the Court issued four orders, denying all of the defendants’ motions, and permitting every single one of the client’s counts to move forward.
